1. Acceptance of Terms
By accessing or using the Browwwser application or website (browwwser.com), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and ARGROUP US LLC, a New Mexico limited liability company doing business as Browwwser (“Browwwser,” “we,” “us,” or “our”), located at 1209 Mountain Road PL NE, STE R, Albuquerque, NM 87110, USA.
2. Description of Service
Browwwser is a macOS web browser with built-in site and app blocking capabilities (the “Service”). The application is designed to help you improve focus and productivity by allowing you to block distracting websites and applications on your Mac.
Key features include:
- Full-featured web browsing based on modern web standards.
- Built-in site blocking with customizable blocklists and preset categories.
- Application blocking to restrict access to distracting macOS apps.
- Scheduling tools to configure blocking during specific hours or days.
- All blocking data stored locally on your device for complete privacy.
3. Eligibility
You must be at least 13 years of age to use Browwwser. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account and Payment
To use Browwwser beyond any free trial period, you must purchase a license. Browwwser is offered under two pricing plans:
- Annual subscription: A recurring annual subscription billed in USD. Your subscription will automatically renew at the end of each billing period unless cancelled before the renewal date.
- Lifetime purchase: A one-time payment in USD granting you perpetual access to Browwwser, including all future updates available at the time of release.
All payments are processed securely through Stripe. Prices are displayed in US dollars (USD). By providing your payment information, you authorize Stripe to charge the applicable fees.
For annual subscriptions, you may cancel auto-renewal at any time. Cancellation will take effect at the end of the current billing period, and you will retain access until that date.
5. Refund Policy
We offer a 14-day money-back guarantee on all purchases. If you are not satisfied with Browwwser for any reason, contact us within 14 days of your purchase date and we will issue a full refund.
To request a refund, email us at admin@browwwser.com with your account email and order reference. Refunds are typically processed within 5 to 10 business days.
6. License Grant
Upon purchasing Browwwser, we grant you a limited, non-exclusive, non-transferable, revocable license to use the application on your personal macOS devices, subject to the following conditions:
- Scope of use: The license is granted for personal use. Commercial or enterprise use requires a separate agreement.
- Non-transferable: You may not transfer, sell, sublicense, or assign your license to another person or entity.
- No modification: You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of Browwwser.
- No redistribution: You may not distribute, copy, or make Browwwser available to third parties.
7. Intellectual Property
All intellectual property rights in and to Browwwser, including its code, design, trademarks, and content, are and remain the exclusive property of ARGROUP US LLC. Nothing in these Terms grants you any right, title, or interest in the Service other than the limited license described in Section 6.
8. User Responsibilities
When using Browwwser, you agree to:
- Provide accurate and complete information when creating your account.
- Keep your account credentials and license key secure and confidential.
- Use the application in compliance with all applicable laws and regulations.
- Not use Browwwser in any way that could damage, disable, or impair the Service.
- Not attempt to circumvent any license validation or security measures.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE CORRECTED.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARGROUP US LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE USE OF BROWWWSER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless ARGROUP US LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Availability and Updates
We strive to keep Browwwser available and up to date, but we do not guarantee uninterrupted access. We may release updates, patches, or new versions at our discretion. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.
13. Termination
You may terminate your account at any time by contacting us at admin@browwwser.com. Upon termination, your license to use Browwwser will be revoked and your account data will be deleted in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your account if we reasonably believe that you have violated these Terms. In the event of termination for cause, no refund will be issued.
14. Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on our website at least 30 days before the changes take effect.
Your continued use of Browwwser after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your account.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ARGROUP US LLC with respect to the Service and supersede all prior agreements and understandings.
